In my Florida divorce case, can I use my spouse’s affair against them?

Technically not, Florida is a no-fault state, which means the fact that they cheated on you has no bearing on the divorce. However, the way to use a cheating spouse’s affair against them is if you have children in common and if they introduced that person to the children, and if that introduction negatively affected the children. You’re going to have to go by the best interest of the child and prove to the judge why it was not in their best interest or why they were negatively affected by this introduction.
